Terms & Conditions

1. The Promotion commences Tuesday 1st September 2009 12.00am AEST & closes Friday 11 December 2009 11.59 AEST (“Promotion Period”).
Entry Requirements
2.    Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3.    Entry is open to residents of Australia. Employees of the Promoter, State Union employees, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter.
4.    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5.    To enter, purchase a 2010 Investec Super 14 membership with any of the Australian Investec Super 14 teams - Waratahs, Queensland Reds, Brumbies, Western Force (“Super 14 Partners”), during the Promotion Period to be automatically entered into the draw.
6.    One (1) entry will be submitted per membership purchased. Multiple entries will be permitted.
7.    The Entrant will be the purchaser of the membership. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
8.    Entrants must retain their purchase receipt(s) for all memberships purchased as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in forfeiture of any right to a prize.
Prize Draw
9.    Entries will close Friday 11 December 2009 11.59pm AEST.
10.     One (1) prize winner (“Winner”) will be drawn randomly from all valid entries received by Super 14 Partners.
11.     The Prize Draw will take place at 3:00pm AEST at Weekes Preston, Suite 205, 22 Mountain Street Ultimo, NSW 2007, on the Tuesday 15th December. The Winner will be notified via telephone, email and mail, and will have their name and state of residence published in The Australian on Friday 17th December 2009.
12.    The Winner’s name and state of residence will also appear at www.rugby.com.au on the 2010 Investec Super 14 Membership Promotion Competition Page.
13.    If any Winner is under the age of 18 years, the prize will be awarded to the Winner's parent/guardian on their behalf.
Unclaimed Prize Draw
14.    The Promoter may conduct an unclaimed prize draw (“Unclaimed Draw”) at the same place and time as the original draw on Monday 15th March 2010 to distribute any prizes unclaimed by that date subject to any written directions given under any regularity authority.
15.    Winners from the Unclaimed Draw will have their name and postcode published in The Australian on Friday 19th March 2010 and will also appear at www.rugby.com.au
Prize
16.    The Winner will receive a trip for two to the 2010 Investec Super 14 Final. The prize consists of:
           i) match tickets for two (valued at a maximum of $170 per ticket, $340 in total)
          ii) two (2) return economy airfares from nearest capital city (valued at a maximum of $2858 per person, $5715 in total),
         iii) airport transfers at destination for two (valued at $100 per person, $200 in total),
         iv) three (3) nights accommodation (Thursday 27th May, Friday 28th May & Saturday 29th May 2010, valued at $360 per night,    

             $1080 in total),
        iv) breakfast for two per day (valued at $35 per breaksfast per person, $210 in total).
17.    The Maximum Prize value is $7545. Prize values are subject to destination, with stated values based on a Super 14 Final played in Durban, South Africa.
18.    The prize must be taken as stated and cannot be varied. No compensation will be payable if the winner is unable to redeem the prize as stated. The prize is not exchangeable or redeemable for cash or other goods and services. The prize cannot be transferred to another person.
19.    Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prizes.
20.    The Prize must be redeemed between Thursday 27th May 2010 – Saturday 29th May 2010.
21.    The prize does not include passport and visa fees, travel insurance, transportation (other than the outlined airport transfers), meals (other than breakfast as outlined), spending money, merchandise of any description, any extra accommodation or any other costs of a personal, incidental or ancillary nature.
General
22.    The personal information supplied by entrants when entering this Promotion will be used by the Promoter in accordance with its Privacy Policy. Please refer to the Privacy Policy by visiting www.rugby.com.au for more information. Entry into this Promotion is an agreement to be bound by that policy. All entrants may have their details removed from the Promoter’s database by simply contacting the Promoter. If details are removed prior to the conclusion of the Promotion and/or award of prize(s), entrants will forfeit their right to claim any prizes.
23.    The Promoter’s decision is final and no correspondence will be entered into.
24.    Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
25.    By entering the competition, Winners agree to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.
26.    If for any reason this promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
27.    Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any variation in prize value to that stated in these Terms and Conditions; (d) if the 2010 Super 14 Final event is cancelled for any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
